Who Is Liable In A Bicycle Accident?

According to California law, cyclists have exactly the same rights and responsibilities as motorists. This means that liability claims (i.e., proving that a driver is responsible for your damages), are handled the same way as car-on-car collisions, with the addition of the relevant bicycle laws governing the area. You can learn more about proving liability in an auto accident on this page.

If you have been injured and would like to pursue damages resulting from a bicycle accident in Los Angeles, your lawyer will need you to:

  • Document any and all injuries, even minor ones.
  • Write down the other party’s information, including their license number and insurance company.
  • Document as much of the scene as possible. This includes weather conditions, road conditions, and any other relevant information.
  • Take pictures. Take pictures of your injuries, your bicycle, the other party’s vehicle, and any other aspects of the scene that could be important later on. Remember, it is always better to have too many pictures than too few.
  • Seek treatment. Your injuries need to be thoroughly documented and treated by a medical professional. We will pursue compensation for your expenses and any necessary treatments when possible.
  • Remain silent. Do not talk to insurance agents if they call you or visit your home. Their goal is to protect their company’s bottom line and prevent you from pursuing and obtaining compensation. Call Los Angeles City Law and we will advise you as to how you should proceed.

Your individual circumstances may require you to take these measures in a different order, or to take different measures altogether. Call Los Angeles City Law at 1-866-522-4895 to speak with us about your specific circumstances.

What You Need To Know About California Bicycle Laws

Many of the roads in Los Angeles have no bicycle lanes, or have very narrow lanes that are often occupied by motorists. With distracted and aggressive driving becoming more and more prevalent on California roads, it is no surprise that many cyclists find themselves seeking the assistance of our Los Angeles bicycle accident attorneys. As a cyclist, there are a few things you should know about bicycle laws in California. While your lawyer will discuss your individual circumstances with you in more detail, the following factors, and more, could affect your case:

  • Freeways: California Vehicle Code (CVC) 21960 states that cyclists are not permitted to ride on freeways where doing so has been prohibited by the California Department of Transportation and/or local authorities. Check with your local area before taking your bicycle on the freeway, as these prohibitions are often put in place due to safety concerns.
  • Brakes: According to CVC 21201(a), your bicycle must be equipped with a brake that allows you to brake on clean, dry, level pavement. Always ensure that your brakes are working before you begin riding.
  • Intoxication: CVC 21200.5 prohibits Californian cyclists from riding a bicycle under the influence of drugs and/or alcohol.
  • Visibility: According to CVC 21201(d), cyclists must take the following precautions when it comes to illumination. Your bike needs to have:
  1. A lamp emitting a white light that illuminates the highway, sidewalk, or bikeway in front of you and is visible from a distance of 300 feet in front and from the sides of your bicycle.
  2. A red reflector, a solid, or a flashing red light with a built-in reflector on the back of the bike that is visible from 500 feet from behind.
  3. A white or yellow reflector on each pedal, shoe, or ankle visible that can be seen from the front and back of the bicycle from 200 feet.
  4. A white or yellow reflector on each side of the front half of your bicycle, as well as a white or red reflector on each side of the back half of your bicycle. If your bicycle has reflectorized tires, then you do not need these reflectors.

These are just a few of the laws you should be aware of before cycling through the streets of Los Angeles. Be sure to follow these and the other relevant laws closely, as failing to do so may hurt your chances of receiving compensation.
